Rules worth knowing
California and NAR rules that come up when a listing goes to a cash buyer.
Business and Professions Code section 10137
A salesperson can be paid for licensed work only by their own broker: no salesperson shall “accept compensation for activity requiring a real estate license from any person other than the broker under whom he or she is at the time licensed.” Licensees may share compensation, provided it is “paid through the responsible broker.”
Business and Professions Code section 10137
A licensed broker may not compensate anyone for licensed acts unless that person is a licensed broker or a salesperson licensed under that same broker. The statute's exception: a broker “may pay a commission to a broker of another state.”
Business and Professions Code section 10176(g)
A licensee can be disciplined for “the claiming or taking … of any secret or undisclosed amount of compensation, commission, or profit,” or for not revealing the full amount to the buyer or seller they contract with.
NAR Code of Ethics (2026), Standards of Practice 1-6 and 1-7
REALTORS® “shall submit offers and counter-offers objectively and as quickly as possible,” and listing brokers keep submitting all offers until closing unless the seller has waived this in writing.

Questions agents ask
What if my listing won't qualify for financing?
Eugene Bay Area Home Buyers buys houses for cash in any condition, vacant or occupied, including homes in foreclosure or behind on taxes, so a lender's view of the condition doesn't end the conversation. Send the address, tell us on the call what's wrong with the property, and we'll tell you whether it's a fit.
Will a cash buyer look at an ugly or uninhabitable listing?
A cash buyer like Eugene Bay Area Home Buyers will. We buy houses in any condition, even when a house is uninhabitable as it stands, and whether it is vacant or occupied. Send the address, then tell us on the call what's wrong with it and who lives there now, and we'll look at it.
How quickly can you close on a listing?
Eugene Bay Area Home Buyers closes in 10-20 days. The exact date still depends on the file: title, escrow, occupancy and what your seller needs. That's why we ask for your seller's timeline when we talk about the address. Send the address, give us the date on the call, and we'll tell you whether it's a fit.
Do I have to present a cash offer from an investor to my seller?
A REALTOR® acting as listing broker does. NAR's Standard of Practice 1-6 says REALTORS® "shall submit offers and counter-offers objectively and as quickly as possible," and SOP 1-7 has listing brokers keep submitting all offers until closing unless the seller waives this in writing.
Who pays commission when a listing sells off market?
California routes a salesperson's pay through their broker. Business and Professions Code section 10137 bars a salesperson from accepting compensation for licensed work "from any person other than the broker under whom he or she is at the time licensed," and shared compensation must be "paid through the responsible broker." Ask your broker how that applies to your sale.
Have a listing that won't finance or sell?
Send us the address and the condition. We'll take it from there.
